FIREARM-MOUNTED ILLUMINATION DEVICE
ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND WAIVER AGREEMENT
PLEASE READ CAREFULLY BEFORE PURCHASING, INSTALLING, OR USING THIS PRODUCT
This Assumption of Risk, Release of Liability, and Waiver Agreement ("Agreement") applies to the purchase, possession, installation, maintenance, and use of the firearm-mounted illumination device ("Product") manufactured or sold by [Company Name] ("Company").
By purchasing, accepting, installing, possessing, or using the Product, the purchaser and/or user ("User") acknowledges and agrees to the terms below.
1. ACKNOWLEDGMENT OF RISKS
The User understands that firearms and firearm accessories involve inherent risks and that the use of a firearm-mounted accessory may create additional risks.
These risks may include, but are not limited to:

Product malfunction or failure.

Electronic or mechanical failure.
-
Loss of illumination.
-
Battery failure, leakage, overheating, or other battery-related issues.
-
Mounting-system failure, loosening, or detachment.
-
Damage to the Product, firearm, mounting system, or other equipment.
-
Improper installation or adjustment.
-
Incompatibility with a particular firearm, mounting system, or accessory.
-
Exposure to environmental conditions, impact, recoil, heat, moisture, or other operating conditions.
-
Property damage.
-
Personal injury.
-
Serious bodily injury.
-
Death.
The User acknowledges that these risks may occur despite reasonable manufacturing, inspection, testing, installation, maintenance, and use of the Product.
2. VOLUNTARY ASSUMPTION OF RISK
The User knowingly and voluntarily assumes all risks associated with the purchase, possession, installation, maintenance, and use of the Product to the fullest extent permitted by applicable law.
The User accepts responsibility for determining whether the Product is appropriate for the User's particular firearm, mounting system, intended application, and operating conditions.
3. USER RESPONSIBILITIES
The User agrees to:

Follow all Product instructions, warnings, and manufacturer recommendations.

Properly install and secure the Product.

Verify compatibility before installation and use.

Inspect the Product and mounting system before each use.
-
Verify that all mounting hardware and attachment points remain secure.
-
Immediately discontinue use if the Product or mounting system appears damaged, defective, loose, overheated, or otherwise unsafe.

Not use the Product if it has been improperly modified, repaired, altered, or damaged.
-
Use appropriate batteries and components as specified by the manufacturer.
-
Comply with all applicable federal, state, local, and other laws and regulations.
-
Exercise appropriate care and follow all applicable firearm-safety practices.
4. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, the User releases and agrees not to hold liable [Company Name], including its owners, officers, employees, contractors, designers, manufacturers, distributors, and representatives, for claims, demands, damages, losses, costs, or expenses arising from or relating to the User's purchase, possession, installation, maintenance, or use of the Product, including claims arising from:

Improper installation.

Improper use.

Misuse or abuse.

Failure to inspect the Product.
-
Failure to follow instructions or warnings.
-
Unauthorized modification or repair.
-
Use with incompatible equipment.
-
Negligent or improper maintenance.
-
Use outside the Product's intended application.
This release applies only to the extent permitted by applicable law and does not waive rights or claims that cannot legally be waived.
5. INDEMNIFICATION
To the fullest extent permitted by applicable law, the User agrees to indemnify and hold harmless [Company Name] and its owners, officers, employees, contractors, designers, manufacturers, distributors, and representatives from claims, damages, liabilities, costs, and reasonable expenses arising from the User's negligent, improper, unlawful, or unauthorized use, installation, modification, or maintenance of the Product.
6. MODIFICATION AND UNAUTHORIZED USE
The User understands that modification, alteration, disassembly, unauthorized repair, or use of the Product with incompatible components may create additional risks and may void any applicable warranty.
The Company is not responsible for performance or safety issues resulting from unauthorized modifications or use outside the Product's intended specifications, to the extent permitted by applicable law.
7. NO GUARANTEE OF FAILURE-FREE OPERATION
The User acknowledges that no electronic, mechanical, optical, or firearm-mounted device can be guaranteed to operate without failure.
The Company does not guarantee uninterrupted operation or suitability for any particular firearm, mounting system, application, environment, or purpose unless expressly stated in writing.
8. LEGAL COMPLIANCE
The User is solely responsible for determining whether possession, installation, transportation, and use of the Product are lawful in the User's jurisdiction and circumstances.
The Company does not provide legal advice concerning firearms, firearm configurations, or the legality of any particular use.
9. ACKNOWLEDGMENT
By purchasing or using the Product, the User confirms that:

The User has read and understands this Agreement.

The User understands that firearms and firearm accessories involve inherent risks.

The User understands that Product failure is possible.
-
The User voluntarily assumes the risks associated with the Product.
-
The User agrees to comply with all applicable instructions and warnings.
-
The User is legally permitted to purchase and possess the Product.
-
The User has had an opportunity to seek independent legal advice regarding this Agreement.
10. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by applicable law.
11. GOVERNING LAW
This Agreement shall be governed by the laws of the State of [STATE], without regard to its conflict-of-law provisions, except to the extent applicable law requires otherwise.
12. ENTIRE AGREEMENT
This Agreement, together with the Company's applicable Terms of Sale, Warranty, Product Instructions, and Safety Warnings, constitutes the agreement between the User and Company concerning the matters addressed herein, unless otherwise required by applicable law.

BY SIGNING ABOVE, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THIS ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND WAIVER AGREEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
